Terms of Service

Last updated

These Terms of Service (“Terms”) are an agreement between you and Crested (“Crested,” “we,” “us”). They cover crested.app, the Crested app builder, and every event app we host. Our Privacy Policy and Refund Policy are part of these Terms.

On this page · 22 sections

1.Agreeing to these Terms

By creating an account, launching an event app, or using an event app as a guest, you agree to these Terms. If you use Crested for an organization, you confirm you’re allowed to agree for it. If you don’t agree, please don’t use Crested.

2.What Crested does

Crested lets hosts design a private web app for an event (a trip, a weekend, a golf outing, a wedding) and share it with their guests, who can add it to their phone’s home screen. Designing and previewing an app is free. Launching an app to guests can require a one-time fee per event; when it does, we show you the price before you pay. Event apps run in the browser; there’s nothing to download from an app store.

3.Your account

  • You must be 18 or older to create a host account.
  • Give us accurate information, including an email address you can access. You need to verify your email before you can launch an app.
  • Keep your password to yourself. You’re responsible for what happens under your account; tell us right away at hello@crested.app if you think someone else has used it.
  • One person per account. Don’t share, sell, or transfer accounts.
  • You can delete your account at any time from your account settings. Deleting it permanently deletes your apps and everything your guests added to them.

4.Hosting an event

As a host, you’re responsible for your event app and how you use it. In particular:

  • Only add people’s names, photos, and contact details when they’d reasonably expect it, typically because they’re part of your event.
  • Only send invitations by email or text to people who have agreed to hear from you about the event. You’re the sender of those invitations; we deliver them for you.
  • Choose who can see your event. Anyone with your event link can open it unless you set an invite code. Use one if your event includes anything you wouldn’t want a stranger to see.
  • Use your guests’ information only for your event.
  • Check your app before you launch. You’re responsible for the accuracy of what it tells guests, including anything Monty filled in.

5.Joining as a guest

Guests don’t need an account. When you join an event, pick your name from the guest list or type it in; please use your own name. What you post is visible to everyone who can open the event, and the host can remove it. The host, not Crested, decides what the event app contains and who is invited. Guests under 13 shouldn’t use an event app on their own.

6.Your content

You keep ownership of everything you and your guests add: designs, text, photos, and files (“your content”). You give Crested a worldwide, non-exclusive, royalty-free license to host, store, copy, resize, display, and transmit your content only as needed to run, secure, and improve Crested for you and your guests, and to show it to the people you share your event with. This license ends when your content is deleted, except for copies kept in backups for a limited time or where the law requires us to keep them.

You confirm you have the rights to what you upload, including permission from people who appear in your photos where that’s needed.

We don’t claim ownership of your content, and we won’t use it in our marketing without your permission.

7.Acceptable use

Don’t use Crested to:

  • break the law or help someone else break it;
  • harass, threaten, bully, or impersonate anyone;
  • post child sexual abuse material, sexual content involving anyone without their consent, content that incites violence or hatred, or content that infringes someone’s intellectual property or privacy;
  • send spam, or send messages to people who haven’t agreed to receive them;
  • collect or sell other people’s personal information without permission;
  • run a gambling business, take a cut of wagers, or accept bets from people outside your event;
  • upload malware, probe or break our security, or get around rate limits, invite codes, or payment;
  • scrape, overload, or reverse-engineer Crested, or use it to build a competing product;
  • use Monty to create content that breaks these rules or Anthropic’s usage policies.

We may remove content or suspend apps and accounts that break these rules (see “Suspension and termination”).

8.AI features (Monty)

Monty is an AI concierge built on models from Anthropic. It suggests and applies changes to your draft based on what you tell it.

  • AI-generated content can be wrong. Monty may suggest details, like addresses, dates, times, prices, or course data, that are inaccurate or out of date. Check everything before you launch.
  • Monty only edits your draft. It can’t book, reserve, pay for, or confirm anything with a venue, airline, or anyone else.
  • You’re responsible for what you publish, including content Monty suggested. As between you and Crested, you own what Monty produces for your app, to the extent we have rights in it.
  • Don’t share passwords, payment card numbers, government ID numbers, or other sensitive information with Monty. Door and Wi-Fi codes for your rental go in the Stay module’s code fields, which are shown only to guests who picked their name, and hidden from guests the day after the trip.
  • What you send Monty is processed by Anthropic as described in our Privacy Policy. We may limit how much you can use Monty to keep it fair and available.
  • Monty is a helper, not an advisor. Nothing it says is legal, financial, medical, or travel advice.

9.Fees and payment

  • Designing and previewing is free. When a launch fee applies, you pay it once for that event. We show you the price, in US dollars, before you pay.
  • The fee covers one event app. It isn’t a subscription and doesn’t renew.
  • Payments are processed by Stripe under Stripe’s terms. You authorize us, through Stripe, to charge the payment method you provide.
  • Any sales tax that applies will be shown at checkout.
  • We may change prices for future launches. A price change never affects an event you’ve already paid for.
  • If we let you launch for free (for example, during an early-access period), we’ll tell you before any fee applies to an app you’ve already launched.
  • Refunds are covered by our Refund Policy.

10.Money, side bets, and payment links

The Money module helps a group keep track of shared expenses and friendly side bets. It’s a ledger, not a payment service: Crested never holds, moves, or transfers money. Payment links such as Venmo or Cash App open those services, and any payment you make there is between you and the other person under that service’s terms. Balances and settle-up amounts are calculated from what people enter and can be wrong, so check before you pay. Side bets are for fun among the people in your event. You’re responsible for making sure any bet is legal where you are, and Crested doesn’t accept, hold, or pay out wagers.

11.Location sharing

Location sharing is off unless a guest turns it on. When you share your location, everyone who can open the event can see it for the time you choose, up to 24 hours. Only share if you’re comfortable with that, and don’t rely on it for safety or emergencies.

12.Text messages

Crested sends text messages on behalf of hosts, for example to deliver an invitation to their event.

  • Message frequency varies by event.
  • Message and data rates may apply.
  • Reply STOP to opt out at any time, or HELP for help. You can also email hello@crested.app.
  • Carriers are not liable for delayed or undelivered messages.
  • Hosts: only text people who have agreed to hear from you about your event, and never use Crested for marketing texts.
  • See our Privacy Policy for how we handle phone numbers. We don’t share mobile numbers with third parties for their marketing.

13.Availability and changes

We work to keep Crested running smoothly, but we can’t promise it will always be available or error-free, and we sometimes need to take it down for maintenance. We may add, change, or remove features. If we remove a feature your launched app depends on, or ever need to retire event apps that haven’t been used for a long time, we’ll email the host at least 30 days in advance so you can save what you want to keep. Otherwise your event app stays live until you take it offline or delete it.

14.Suspension and termination

You can stop using Crested and delete your account at any time. We may suspend or remove an event app, content, or an account if we reasonably believe it breaks these Terms, puts people at risk, or exposes Crested to legal liability. Where it’s reasonable, we’ll tell you first and give you a chance to fix the problem. If we close your account for a reason other than a breach of these Terms, we’ll refund the fee for any paid event that hasn’t happened yet. Terms that by their nature should survive, such as payment obligations, disclaimers, limits on liability, and dispute terms, survive termination.

15.Disclaimers

Crested is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don’t guarantee that information in an event app, whether entered by a host, a guest, or Monty, is accurate, complete, or current. We’re not responsible for the events themselves, for venues, travel, or other services you arrange, or for what hosts and guests do.

16.Limitation of liability

To the fullest extent the law allows, Crested won’t be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from or related to your use of Crested. Our total liability for any claim related to Crested is limited to the greater of what you paid us in the 12 months before the claim or US $100. Some places don’t allow these limits, so they may not apply to you.

17.Indemnity

If you use Crested as a host, you agree to defend and indemnify Crested against claims, losses, and costs, including reasonable attorneys’ fees, that arise from your event app, your content, the invitations you send, or your breach of these Terms.

18.Disputes and governing law

If you have a problem with Crested, email hello@crested.app first. Most issues can be solved quickly, and we’ll both try in good faith for 30 days before either of us goes to court.

These Terms are governed by the laws of the state in which Crested is organized and applicable US federal law, without regard to conflict-of-law rules. Either of us may bring a qualifying claim in small-claims court. Any other claim must be brought in the state or federal courts located in that state, and we both consent to their jurisdiction.

20.General

These Terms, with our Privacy Policy and Refund Policy, are the whole agreement between you and Crested about the service. If any part is found unenforceable, the rest stays in effect. If we don’t enforce a term right away, we haven’t waived it. You can’t transfer these Terms without our consent; we may transfer them as part of a merger, acquisition, or sale of assets. Neither of us is responsible for delays caused by events beyond reasonable control.

21.Changes to these Terms

We may update these Terms. If a change is material, we’ll update the date at the top and tell hosts by email or in the app at least 14 days before it takes effect, unless a change is needed sooner for legal reasons or to stop abuse. If you keep using Crested after a change takes effect, you accept it; if you don’t agree, you can delete your account.
